Cub Cadet Champion Experience Official Contest Rules

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.

1. Eligibility

The Cub Cadet Champion Experience (the “Contest”) is open to residents of Canada (excluding Quebec) who have reached the legal age of majority in their province or territory at time of entry. An employee, representative or agent of the winner selection team, contest administrator, Cub Cadet, Golf Canada, RBC, affiliated agencies, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, as well as immediate family (spouse, parents, siblings and children) and household members of each such employee, representative or agent are not eligible to enter or win the Grand Prize. The Contest is subject to federal, provincial and local laws and regulations.

2. Sponsor

This Contest is sponsored by Cub Cadet Canada (“Cub Cadet Canada”) with its principal office located at 97 Kent Ave, Kitchener, ON N2G 3R2.

3. Agreement to Official Contest Rules

Participation in this Contest constitutes entrants’ full and unconditional agreement to and acceptance of these Official Contest Rules and the decisions of the Sponsor, which are final and binding. Winning the Grand Prize is contingent on being compliant with these Official Contest Rules and fulfilling all other requirements as set forth herein.

4. Contest Period

The Contest begins on March 1, 2022 at 12:01 p.m. EST and ends on May 15, 2022 at 11:59 p.m. EST (the “Contest Period”). Entries that are submitted before or after the Contest Period are not valid. Submissions will be accepted for the duration of the Contest Period using any of the methods outlined below.

5. How to Enter

Entry with Purchase:

Entrants are automatically entered into the Contest upon the purchase and registration during the Contest Period of a new 2022 Spring or Summer line Cub Cadet Product (not including parts and accessory purchases) with a minimum purchase price of CAD $400 or more. The purchase of more than one product or separate purchases with an aggregate value of CAD $400 or more do not qualify as a valid entry. Purchases of such new Cub Cadet Products may be made at Cub Cadet independent retailers, mass retailers or online at www.Cubcadet.ca. Please Note: Independent retailers will automatically register Cub Cadet Product purchases. However, a purchase of a new Cub Cadet Product online or at a Mass Retailer will require registration directly by the purchaser, after which such purchaser will be automatically entered into the Contest. Purchases of a used machine / product from any source or of a new machine / product that is not part of the 2022 Spring or Summer line, or that are not made during the Contest Period, do not qualify as an entry to the Contest. Registrations that are incomplete or do not adhere to the rules or specifications of the Contest may be disqualified at the sole discretion of the Sponsor.

Alternate Method of Entry – No Purchase Necessary:

For an alternate method of entry with no purchase necessary, please send a note by mail with the subject line: “The Cub Cadet Champion Experience” including your first and last name, email address, postal code, phone number including area code, language preference, and acknowledge acceptance of these rules and regulations, in writing to the Contest administrator: RedRhino Inc., 201-205 Horton Street E, London, ON. Written entry must be received before the end of the Contest Period. Information provided must be complete, accurate and legible to be accepted. Sponsor is not responsible for any lost, late, damaged, incomplete, misdirected or illegible mail-in entries.  Proof of mailing will not be deemed to be proof of receipt of any mail-in entries by Sponsor.

Other Restrictions

Limit one (1) entry per person through the duration of the Contest Period regardless of entry method. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the Contest, your submission may be disqualified at the sole discretion of the Sponsor. All entries become the property of the Sponsor and will not be acknowledged or returned.

6. Contest Prize

Grand Prize:

Provided that the requirements of these Rules are met, the winner will receive ONE (1) GRAND PRIZE consisting of:

  • 2 RBC x Music VIP Experience on Saturday, June 11, 2022;
  • 2 general admission tickets to RBC Canada Open on Sunday, June 12, 2022;
  • 2 invitations to the Champions Reception on Sunday, June 12, 2022;
  • 2 playing positions in “Monday After Experience” on Monday, June 13, 2022; and
  • one CDN $2,000.00 Visa Gift card to be used towards accommodation, travel & entertainment.

APPROXIMATE VALUE: $5,000.00 CDN

The Visa Gift card offered for this Contest as part of the Grand Prize is subject to the rules and regulations, terms and conditions of the card issuer, as amended from time to time. The event and experience portions of the Grand Prize are subject to the rules and regulations, terms and conditions of such events and experiences. https://info.cubcadet.ca/champions-rules/ By entering the Contest, the Entrant agrees to be bound by all such rules and regulations, terms and conditions. Cub Cadet Canada, the event and experience sponsors, and the card issuer will not be responsible for any lost, stolen, or misplaced gift cards or tickets, or gift cards that have expired with a balance remaining on them after they have been delivered to the winner, or any fees or charges associated with gift cards in any way. The Visa Gift Card and event and experience tickets will not be replaced, refunded or reimbursed if lost, stolen or misplaced. Purchase amounts that exceed the value of the gift card will require payment by the user by some other method for the balance due.

Personal information will not be shared with parties outside of this Contest except as otherwise indicated. The companies offering the gift card and running the events/experiences are not sponsors of the Contest or the Grand Prize nor are they otherwise affiliated with Cub Cadet Canada. Personal information will not be shared with these companies. The logos and other identifying marks included are trademarks of and owned by each represented company and/or its affiliates. Within five (5) days of being selected as the winner, the potential winner and any guest(s) that will utilize the event/experience tickets must execute the Sponsors’ Declaration of Eligibility and Liability/Publicity Release prior to the Grand Prize being awarded.

All other expenses not specifically included above are the sole responsibility of the winner. For greater certainty, the winner may use the $2,000.00 Visa Gift Card towards travel, accommodation, meals and other entertainment expenses; however, the winner will be required to cover any such expenses over the $2,000 value of the gift card.

Without limiting the generality of the foregoing, the following general conditions apply to the Grand Prize (i) prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may otherwise be specifically permitted by Sponsor in its sole discretion); (ii) Sponsor reserves the right at any time to substitute the Grand Prize or a component thereof for any reason with a prize or a prize component of equal or greater value, including, without limitation, but at the Sponsor’s sole discretion, a cash award; and (iii) by accepting the prize, the winner agrees to waive all recourse against the Sponsor if the prize or a component thereof does not prove satisfactory, either in whole or in part.

The winner assumes any and all liability for any injury or damage caused, or claimed to be caused, by entering or participating in this Contest or the use or redemption of the Grand Prize. The Grand Prize or any portion thereof cannot be combined with other discounts, promotions or special offers.

7. Grand Prize Drawings

On May 17, 2022 at 10:00 a.m. EST at 201-205 Horton Street E., London, ON, Sponsor or its administrator will randomly select one (1) potential winner of the Grand Prize from all eligible entries received during the Contest Period.

Odds of winning depend on the number of entries received during the Contest Period. Selected potential winners must be in compliance with all of the Official Contest Rules, in the Sponsors’ sole discretion, in order to claim his/her Grand Prize.

By entering this Contest, entrants authorize the Sponsor or its administrator to use, as required, his/her name, photograph, likeness, place of residence, voice and/or statement in connection with the Grand Prize for advertising purposes, without further notice, remuneration or compensation of any kind.

In order to be declared a winner and prior to receiving the Grand Prize, the selected entrant and any guest(s) attending the Grand Prize events/experiences with the winner must sign the Sponsor’ Declaration of Eligibility and Liability/Publicity Release Form, which shall be completed and returned within five (5) as required by the Sponsor and requires the potential winner to: (i) confirm compliance with all Official Contest Rules; (ii) agree to accept the Grand Prize as awarded; (iii) release, discharge and hold harmless the Sponsor, Golf Canada, RBC, the gift card issuer, the organizations running the events and experiences associated with the Grand Prize, and their respective its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from any liability for any injuries (including death), losses, actions, demands, costs, expenses, (including legal fees), and damages of any kind (including direct, indirect, incidental, consequential or punitive damages) to persons or property (collectively, “Losses”) resulting from or in connection wiith the Grand Prize, including the acceptance, possession, misuse or use of the Grand Prize, or the merchandise for which it is redeemed, or this Contest including from entry or participation in this Contest and access to and use of the Contest website; and (iv) indemnify the Released Parties against any Losses that any of the Released Parties may suffer or incur as a result of any non-compliance by the entrant with any of the Official Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of a Grand Prize and the use of the entry by Sponsor.  Potential winners must also correctly answer a time-limited mathematical skill-testing question to be administered by telephone or email at a mutually convenient time in order to be declared a winner.  Cub Cadet Canada assumes no responsibility for the participation in the Contest or any Losses that may be sustained by the entrants, contestants, winners and/or guests.  Released Parties are not responsible for, and each entrant hereby releases the Released Parties from, any claims arising from: (i) lost, late, illegible, mutilated, misdirected, damaged, corrupted, inaccessible, inaccurate or incomplete entries, entries not received by the time designated for the Contest Period; (ii) technical failures of any kind, including but not limited to the malfunctions or interruptions of any computer, equipment, cable, network, hardware or software, programming, or technical problems or traffic congestion on the Internet; (iii) unauthorized human intervention in the entry process or technical or human error which may occur in the administration of or processing of entries in this Contest, including but not limited to delays by Canada Post in delivering mail; (iv) any injury or damage to persons or property, including but not limited to entrant’s computer, hardware or software, including which may be caused, directly or indirectly, in whole or in part, from entrant’s entry in this Contest; and (vi) theft, tampering, destruction, or unauthorized access to, or alteration of entries. Sponsor is not responsible for any electronic or typographical errors in the printing, advertisement or reproduction of these Official Rules, in any advertisement or promotional material related to this Contest (print or online) or in administration of this Contest including but not limited to prize depiction or announcement of any winner.

The provisions of this section shall survive the termination of this Contest and may be relied upon by the Released Parties at any time.

Sponsor is not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded the Grand Prize, including, but not limited to, human error, technical malfunctions, lost or delayed entries for any reason, omission, or any combination thereof, and entries which fail to fully comply with these Official Contest Rules; (ii) technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or other Contest forms; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding, the Contest or accepting the Grand Prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any Grand Prize, including any travel related thereto; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.

8. Winner Notification

The potential winner will be notified via email within five (5) business days of the draw and up to a maximum of two (2) times. If a potential winner does not respond as indicated in the notice within two (2) days of the notice or attempted notice, that potential winner forfeits his/her potential Grand Prize. In the event that a potential winner is disqualified for any reason, the Sponsor will award the applicable Grand Prize to an alternate winner by a random draw from all the remaining eligible entries received during the Contest Period. Only three (3) alternate drawings will be held, after which the Grand Prize will remain un-awarded.

Within ten (10) business days of the successful Grand Prize awarding, save and except in the event of any unforeseen events such as, but not limited to, a weather event, postal or courier strike, flood, fire, war, break out of disease, quarantine, hydro outage, or service provider problems, the Grand Prize will be delivered to the winner.

9. Other Conditions

Termination: Sponsor reserves the right to terminate, modify or suspend the Contest at any time and in any way, without prior notice.  Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Contest and conduct a random draw from all eligible entries previously received during the Contest Period.  Inclusion in such drawing shall be each entrant’s sole and exclusive remedy under such circumstances.

Publicity and entrant information: By participating in the Contest, entrants consent to the use of their name, address, postal code, telephone number, social media handles, social media comments and image, whether on videotape or photograph or any other means, for the administration of this Contest or any publicity carried out by the Sponsor, without further notice or compensation, worldwide and in perpetuity, in any and all forms of media and social media now known or hereafter devised, including, but not limited to, the Internet, Facebook, Instagram, Tik Tok, Twitter, Linked In, You Tube, Pinterest, SnapChat and in any publicity or advertising carried out by Cub Cadet Canada, unless prohibited by law. Cub Cadet Canada reserves the right to post or publish any winner’s name, city, or province of residence, photograph, likeness, voice or other statements, as directed by the winner, on its website and/or on the website of Cub Cadet Canada and affiliated companies for advertising and promotional purposes, where lawful, without further compensation to the winner, worldwide and in perpetuity. By entering the Contest, entrants consent to the collection, use and disclosure of their personal information in accordance with the Sponsor’s privacy policy, available at: https://www.cubcadet.ca/en/privacy-policy.html. Names collected for this Contest will not be sold to any third party without consent.

Cub Cadet Canada will use personal information the entrant submits for the purposes of contacting a contestant and awarding the Grand Prize should the contestant be declared as a winner. By entering the Contest, the entrant who wins the Grand Prize, agrees to have their name published.

Governing law and disputes: The Contest is void where prohibited by law.  Except where prohibited by law, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or the Grand Prize awarded shall be resolved individually, without resort to any kind of class action, and exclusively by the appropriate court. Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, entrants’ rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Ontario and the Federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules.

Rule amendments: The Sponsor reserves the right, in their sole discretion, to amend or modify these Contest Official Rules, without prior notice for any reason whatsoever, including, without limitation, in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

Intellectual property: All intellectual property, including, but not limited to, trade-marks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations, is owned by or licensed to the Sponsor.  All rights are reserved.  Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited.  Sponsors’ marketing or other partners, if any, shall also have access to and rights to reproduce, copy or otherwise use any materials generated by this Contest or any submissions or materials generated by entrants.

Any and all taxes on the Grand Prize awarded, including income taxes, and any incidental expenses associated with collection of the Grand Prize, are the sole responsibility of the winner. All Internet fees, transactional fees, down-loading fees, up-loading fees, accessories, application fees, Wi-Fi costs, roaming charges, costs of programs, long distance charges, travel expenses, mileage, accommodations, meals and extraordinary expenses, including but not limited to beverages and any feature and accessory not expressly listed as part of the Grand Prize shall be the sole financial responsibility of the Grand Prize winner. None of the entrants and/or the Grand Prize winner will be eligible to seek reimbursement for the same from Cub Cadet Canada, their affiliates or representatives or any other party to this Contest.
